In a Public Notice providing “additional guidance” regarding the post-narrowbanding world, the FCC announced that, effective April 1, 2014, applications to renew 150-174 and 421-470 MHz applications that list only wideband emission designators will be dismissed unless the applicant proposes to replace wideband with narrowband designators or the applicant certifies that its wideband equipment meets the narrowband efficiency standard. The notice encourages licensees to modify their emission designators to reflect narrowbanding compliance prior to filing a renewal using the ULS tool implemented for that purpose. Renewal applications listing both wideband and narrowband designators may be returned.

The FCC is seeking comments on a waiver request by Mobile Relay Associates (MRA) to utilize three 4k 450 MHz channels that are located within the band edge between Part 90 I/B Pool and Broadcast Auxiliary Service (BAS) spectrum. The Public Notice requests comment on whether MRA’s use of 4 kHz bandwidth equipment in this “guardband” spectrum create any harmful interference to frequencies on either side of the requested frequencies and specifically invites comment from parties whose operations could be impacted. EWA will be filing comments in support of this assignment for I/B use.

In their first FCC filing since the alliance’s organization, Dynamic Spectrum Alliance, a global organization advocating for laws that lead to more efficient and effective use of spectrum, supported the FCC’s efforts to increase access to unused radio frequencies in the 600 MHz, 3.5 GHz, and 5GHz bands. Paul Garnett, Dynamic Spectrum Alliance Chairman of the Board and Director of Technology Policy at Microsoft, commented “We applaud the FCC’s groundbreaking efforts and are eager to work with the Commission to ensure the most efficient and effective use of spectrum across a range of complementary frequencies and regulatory models. We ultimately believe that dynamic spectrum access technologies will bring major, lasting benefits to consumers”.
LMCC Preparing Rulemaking on 800 MHz Spectrum Access Procedures
The LMCC membership has approved filing a Petition for Rulemaking proposing to limit eligibility to 800 MHz Expansion Band and Guard Band channels to incumbents already operating systems within their geographic areas for six months, after which all channels would be available to all categories of 800 MHz eligible applicants. This decision follows a meeting with the FCC in which LMCC raised concerns about the possibility that significant numbers of applications for commercial service could create mutual exclusivity problems that could be difficult to resolve in the frequency coordination process. The LMCC intends to file this Petition perhaps as early as next week.

Jointly with the American Petroleum Institute (API) and the Utilities Telecom Council (UTC), EWA has announced that it is seeking the FCC’s assistance to create a Private Land Mobile (PLM) Broadband network at 900 MHz that would be established on a 3/3 MHz contiguous allocation of spectrum that would enable LTE technology. In a formal letter to the FCC, the associations emphasized the critical need of private land mobile users to be able to access broadband spectrum dedicated to their unique requirements. As a first step, the organizations requested a “light freeze” of the band for six months while the reorganization plan is developed. During this period, just as in the prior 900 MHz freeze, incumbent licensees in a market would be permitted to add frequencies and modify their authorizations in markets within which they are currently operating, but no applications for new systems would be granted during the freeze.
